Terms of Sale
These Terms will apply to any contract between us for the sale of Products to you. Please read these Terms carefully and make sure that you understand them, before ordering any Products from the Website. Please note that by ordering any Products from our Website you are agreeing to be bound by these Terms and the other documents expressly referred to in them.
These Terms, and any contract between us, are only in the English language.
1 The contract
1.1 If you place an order online through our Website to purchase a Product we will send you an email confirming receipt of your order and containing the details of your order. Your order represents an offer to us to purchase a Product which is accepted by us when we deliver the Product to you. You warrant that you are legally capable of entering into binding contracts with us.
2 Our Products
2.1 The images of the Products on our Website are for illustrative purposes only. Although we have made every effort to display the Products accurately, we cannot guarantee that your computer's display of the Products accurately reflect the Products. Your Products may vary slightly from these images.
3.1 All Products shown on our Website are subject to availability. We will inform you as soon as possible if the Product you have ordered is not available and we will not process your order. If you have already paid for the Products we will offer you a full refund.
4 Information from you
4.1 Before we can process your purchase you must provide us with (i) your name, address and email address; and (ii) details of the credit or debit card that you wish to use. We will use this information to process your order. It is your responsibility to ensure you have provided us with the correct information.
4.2 When you submit your payment details, these details will be transferred to our payment provider, PayPal, and your payment data will be collected and processed securely by them. You should make sure that you are aware of PayPals terms and conditions, which are different from our own, to ensure that you are comfortable with how they will process your personal and financial data before you make an order.
5 Cancellations and Returns
5.1 If you are contracting with us as a consumer, you have the right to cancel your contract at any time up to seven working days after the day on which you receive the goods you ordered. You must take reasonable care of the goods whilst in your possession and they must be returned to us. You must inform us in writing of the cancellation of the contract. You can do so by emailing us at firstname.lastname@example.org.
5.2 We offer a 14 day returns policy (or 21 days for overseas returns), which begins from the date you received the Products. Any returns outside of this period will not be refunded unless damaged or defective. All unwanted Products should be returned in a resaleable condition. This does not affect your statutory rights.
5.3 When you send your Product back to us we will process the returned Product and offer you the choice of a replacement or a refund. If you request a refund we will refund the full price of the goods and any applicable delivery charges you paid for. You can expect a refund in the same form of payment originally used for purchase within 30 days of our receiving your return.
5.4 Unless the Products are faulty or not as described, you will be responsible for the cost of returning the Products to us. Advice about your legal rights as a customer is available from your local Citizens' Advice Bureau or Trading Standards office.
6.1 We normally include a delivery cost to postcodes located with England. International delivery may incur a higher delivery charge and may take longer than delivery to an address in the UK.
6.2 Orders that are shipped overseas may be subject to import duties and taxes which are applied when the delivery reaches that destination. Unfortunately we have no control over these charges and cannot predict what they may be. You will be responsible for payment of any such import duties and taxes. For further information, please contact your local customs office.
6.3 You must comply with all applicable laws and regulations of the country for which the Products are destined. We will not be liable or responsible if you break any such law.
7.1 All of the proceeds of the sale of the Products will go to Actilean Limited and are used to fund the company.
8 Amendments to the Terms
8.1 We reserve the right to make changes to our website, policies and these Terms at any time. You will be subject to the Terms in force at the time that you purchase Products from us, unless any change to these Terms is required by law (in which case it will apply to orders previously placed by you). If any of these Terms are deemed invalid, void, or for any reason unenforceable, that term will be deemed severable and will not affect the validity and enforceability of any remaining term.
9 Events beyond our reasonable control
9.1 We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a contract if the delay or failure arises from any cause which is beyond our reasonable control.
10 Limitation of Liability
10.1 We will not be responsible for any business loss (including loss of profits, revenue, contracts, anticipated savings, data, goodwill or wasted expenditure) or any other indirect or consequential loss even if the loss was reasonably foreseeable to both you and us when the contract for the sale of the Products was formed.
10.2 We do not in any way exclude or limit our liability for death or personal injury caused from our negligence or breach of duty or caused by our gross negligence or wilful misconduct.
11 Governing law
11.1 These Terms are governed by and construed in accordance with English law and are subject to the exclusive jurisdiction of the English courts.
